General
(1) Word Cup is an online vocabulary championship, designed to test both vocabulary and spelling aptitude in a time restricted environment.
(2) Use of this site or participation in Word Cup signifies your agreement with the following rules. If you do not agree, you may not use this site or participate in Word Cup.
(3) There are no entry fees.
(4) Everyone who is 14 of age or older on January first of the year of the Word Cup finals is invited to participate, regardless of location.
(5) Contestants are divided into three age categories:
Category I - 14-30 years of age
Category II - 31-50 years of age
Category III - 51 years and older
(6) Word Cup consists of three distinct rounds: Tryouts, Semi-finals, and Finals, and participation in the next round is based on your performance in the previous round.
(7) Try-out rounds for the three age categories will be held at different times. Register at www.Word-Cup.org, and we will invite you when your age category is scheduled to try out. Schedule.
(8) Word Cup is an U.S. event and open to a global audience.
(9) All three rounds of Word Cup (try-outs, semi-finals, and finals) take place online, with increasing supervision.
(10) Word Cup is a time-restricted event. It is recommend to take a few practice quizzes before trying out to familiarize yourself with the Word Cup quiz format.
(11) Contestants who end the quiz before scoring a minimum of 3 points may try again. This was implemented to allow contestants to try again at another time if you encounter computer problems after launching the event.
(12) It is your responsibility to ensure reliable Internet access throughout the quiz. An interruption in Internet connectivity can cause errors during the quiz and may cause erroneous termination.
(13) You may only compete in Word Cup once per year.
Contestants attempting to enter more than once will be permanently barred from the event.
(14) Once you have won a prize in a previous Word Cup you will not be awarded the same or any lower prize in that same age category, regardless of your score.
You may continue to try out, and can win prizes if you improve upon your previous rank. For example, if you have previously won a first prize, your opportunities will be limited to the "Champion of Champions" title and prize. Once you won the "Champion of Champions" title, you may no longer try out.
(15) You are ineligible to participate and win Word Cup prizes if you or someone in your household or family is employed in any capacity by or volunteered for Word Cup within the past year.
(16) Eligibility determinations by Word Cup staff are final and binding in all respects.
Registration
(17) Out of respect for your privacy, we collect as little personal information as possible. This information is used only to ensure that you are competing in the proper age category, compete under your true identity, and can be contacted throughout the event.
(18) Please note that your identity may be verified at different stages of the competition, and purposefully providing false information to gain an advantage will permanently exclude you from Word Cup.
(19) We may not verify or act upon fraudulent registrations or other unfair behavior immediately. This does not impact our right to exclude anybody at any stage of the event who tampers with the system, registers multiple times, or who breaks these rules in any other form.
(20) Upon registering, you will receive email correspondence from eSpindle Learning, providing your verification of your Word Cup registration and related updates.

If you do not receive an email shortly after registering, please check your spam folder, and, if the email is not found, contact us via livechat.
(22) You need to be able to receive emails to participate. It is your responsibility to maintain an email account, confirm it, monitor it, and to white list the eSpindle.org domain in your email program to ensure proper delivery of our emails. To learn how to white list a domain, click here. Since email is the only communication channel we collect from you, eSpindle Learning is not, under any circumstances, responsible for failed communication based on failure to receive our emails (including delivery to the spam folder, accidental deletion, delivery errors, etc.)
(23) If you are one of the winners, either for prizes of rewards, we may list your first and last name and zip code/country on our website, unless you contact us to inform us that you would rather be listed with your username. If you are a first prize winner we may also provide your email address to select members of the media.
Quiz Format
(24) Contestants may not consult any reference materials or other persons during the Word Cup quiz. Breaking this rule will permanently exclude you from the competition.
(25) It is your responsibility to make sure that your audio is working properly before starting the quiz. A test button is provided on the initial page.
(26) All contestants will be presented with the identical list of words.
(27) Contestants can earn bonus points by entering the word correctly before hearing it – this step is called a “guess.” Entering a wrong guess has no negative effect; however, bonus points are assigned for guessing the word correctly.
Some Word Cup questions may be susceptible to more than one answer, but only the answer predefined in the Word Cup quiz engine will be accepted as the “correct” answer and earn a bonus point.
(28) The audio will automatically play after a non-scoring guess has been submitted, or when only 15 seconds are left in the quiz.
(29) Submitting a misspelled word after listening to the audio will end your Word Cup quiz. The quiz will also end if the time expires before you press the “submit” button. The time given for each word is strictly limited. A timer indicates the time remaining.
(30) You can take a break between words. Simply remain on the answer screen, and do not request the next word. At this point in the quiz you can interrupt activity for up to 15 minutes before timing out. During your finals, the amount of time on break is limited to 15 minutes total.
(31) Your score consists of the total number of words mastered (one point per successfully entered word), plus any bonus points earned by guessing correctly.
(32) Whenever two contestants have the exact same score, the one who has achieved this score in less time ranks higher.
(33) The Word Cup quiz presents audio, a brief, strongly abbreviated definition ("hint"), a sample sentence, the word’s approximate length, and the word's part of speech to allow you to successfully distinguish homonyms. Please take all information given into consideration before submitting your answer.
(34) The hints provided during the quizzes are not definitions in a traditional lexicographical sense, and are not necessarily taken from one of the Word Cup's dictionary resources. Due to the time restriction in place, these hints are edited for easy comprehension, and thereby are incomplete by necessity.
(35) The audio can be repeated as often as you like. Notice, however, that you have only 15 seconds after the audio was first played to submit your answer, or the quiz will time out and terminate.
(36) Capitalization will not cause an entry to be dismissed. “WORD” and “Word” and “word” are all considered equal during the quizzes.
(37) Many words have multiple acceptable pronunciations. During Word Cup only one variant is available. The pronunciation you hear may be slightly different from the pronunciation commonly used in your community.
(38) Always take the time to proofread your entry, since all submissions are final.
(39) Word Cup strives to accommodate contestants who have physical challenges. Please share ideas of how we can accommodate you better. We will consider your feedback and suggestions carefully and improve our offering if and as soon as we are able to do so.
Word Cup Fund
(40) Word Cup is hosted by eSpindle Learning, a nonprofit organization dedicated to education. While eSpindle Learning provides the proprietary engine, database, and administration for the event, Word Cup is powered by community.
(41) Word Cup participants are encouraged to become Word Cup supporters by contributing to the Word Cup Fund. This fund is managed in a dedicated account and supervised by an independent accounting firm.

Word Cup funds are used to cover event-related expenses, boost the Word Cup 2.0 prizes, and raise funds for the Word Cup Literacy fund. Funds are distributed equally to boost prizes and to build the literacy fund. For example, if we raise $20,000, we will be able to give away $10,000 in prizes and will have raised $10,000 for the wonderful literacy projects we support.
(43) As more and more people participate, the Word Cup 2.0 prizes will increase until their maximum value has been funded. All surplus funds are added to the literacy fund.
(44) By contributing to the Word Cup fund, participants qualify for receiving Word Cup 2.0 prizes if they score for prizes or rewards.
The prizes listed in the blue column on the right of the prize page come directly from this Word Cup community fund and are reserved for supporters only.
(45) If a winner is not a Word Cup supporter, he or she is not eligible to receive the Word Cup 2.0 prize, and that prize will be added to the Word Cup Literacy fund.
(46) The level of contribution required to become a Word Cup supporter increases substantially with every round. As an alternative to donating, participants may also create a fund raising page and invite their friends and family to pledge on their behalf.
(47) The nine highest scoring supporters will determine at the end of Word Cup how the funds will be distributed among the participating literacy projects voting as equals.
Semi-Finals
(48) The highest scoring try-out contestants (top 20%) will be invited to the Semifinal round at the end of each try-out season.
(49) If you are under the age of 18 and are invited to enter the finals, your parents must sign the semi-final form to show they agree with your participation in the higher rounds.
(50) To participate in the Semifinal round, contestants will need an independent party to verify and confirm their identity. This independent party (a teacher, librarian, neutral member of the local community, etc.) will also certify that the quiz was taken without assistance and will sign the entry form that is made available to you when you qualify for the semi-finals.
(51) It is the responsibility of the contestant to locate an independent authority and make arrangements to participate in the Semifinals.
(52) Note: You ONLY have to submit the form if you have been invited to the Finals. Please hold on to it carefully since we cannot admit you if you lose the original entry form.
Finals
(53) The top 12 highest-scoring contestants in each age category will be invited to the finals.
(54) Before participating in the finals, you need to submit the completed and signed semi-final entry form by faxing it to 415-814-5727.
(55) If you do not submit this required documents in time or are unable or unwilling to participate in the Finals on any of the designated dates, you will forfeit your opportunity.
(56) Invitation to the Finals is based on performance during the semi-finals exclusively.
(57) The top 36 finalists are scheduled to take the final quiz under direct supervision. Using web camera, microphone, headset, and remote desktop technology, contestants will verify their identity with their Word Cup supervisor and take the quiz under strictly monitored conditions.
(58)
Web camera, microphone and headset can be borrowed in exchange for a deposit. Remote desktop sharing is facilitated through GoToMeeting, and finalists need to download a small driver to enable desktop sharing.
(59)
If a finalist is not able to keep the scheduled appointment, notice has to be given at least 24 hrs ahead of the scheduled session. Rescheduling is only possible once, after which the opportunity to try out for the finals is given to the next person in line.
(60) The days of the finals and the date for announcing the winners are published on Word Cup's website.
(61) The Word Cup winners are determined based on their score during the finals only. Any points earned during previous rounds are part of pre-qualifications and do not apply.
Prizes
(62) Prizes are awarded to the top twelve spellers in each of the three age categories.
(63)
The nine highest-scoring supporters will further have the honor to determine how the Literacy fund is distributed among supported literacy organizations.
(64) The overall highest scoring individual is declared “Champion of Champions” and earns a bonus prize in addition to the first prize in his or her age category.
(65) A large number of smaller rewards will be distributed among the participants based on merit, to ensure that everyone has a chance to win. During future Word Cups these additional prizes are awarded to participants who show the largest improvement compared to the previous year.
(66) The current list of prizes is published on the web site and may be subject to change without prior notice.
(67) Participation in Word Cup is free, and anybody can win the prizes and rewards sponsored by eSpindle Learning, listed in the left column on that page.
(68) Prizes listed in the right, blue column are reserved for Word Cup supporters only.
(69) eSpindle Learning will issue contest-related tax reporting in compliance with applicable laws and regulations. As a condition of receiving and using any prizes, participants agree to self-report to applicable local taxing authorities, as may be required by local laws.
(70) In-kind prizes can not be substituted by their cash value. Winners will receive information regarding the delivery of the prizes within 10 days from the final announcement of winners. Prizes not claimed within 30 days of notification will be added to the Word Cup literacy fund.
Preparation
(71) eSpindle provides free ongoing practice quizzes, frequently updated, year-round at www.eSpindle.org/free_quiz. This page also contains banners that, once incorporated into a website or blog, allow anybody to host the free practice quiz within their web page (no need for visitors to leave your page).
(72) It is recommended that all contestants take a few of these quizzes to get used to the format and time frame allotted for each word.
(73) The only way in which the practice quizzes differ from the real Word Cup is that during Word Cup submitting a wrong entry after hearing the word will terminate the quiz, whereas during the practice quizzes you are permitted to continue.
Dictionaries
(74) The Word Cup looks towards Merriam-Webster's online Third New International Dictionary, Unabridged, and the resources provided on www.answers.com to verify acceptable spelling variants.
(75)
If more than one spelling is listed for a word then any of these spellings will be accepted as correct by the quiz engine if:
(a) The pronunciations of the variants are identical, AND
(b) the definitions of the words are the same, AND
(c) the words are listed as variants of each other.
(76) Variants that are no longer in common use (for example archaic or obsolete versions) will not be accepted.
(77)
Variants from different English-speaking cultures, regional and non-standard variations (such as slang) will be accepted, as long as they are noted as an accepted variant for a word by at least one of the dictionaries consulted.
Media partners and sponsors
(78) Word Cup is solely administered and managed by eSpindle Learning, a 501(c)3 nonprofit organization.
(79) Media partners are organizations who agree to provide publicity support to Word Cup. Agreeing to a media partnership role does not transfer ownership or liability in any shape and form.
Any duty, responsibility or liability, express or implied, is explicitly waived.
(80) Sponsors may contribute to prizes, support the Word Cup fundraising campaign, or directly support the event. Sponsorship support, whether in-kind or monetary, does not imply ownership of the event or liability in any shape and form.

ALL INTERNATIONAL, FEDERAL, STATE, LOCAL OR OTHER TAX LIABILITIES (AND THE REPORTING CONSEQUENCES THEREOF), AS WELL AS SHIPPING, HANDLING AND/OR IMPORT COSTS ARE THE SOLE RESPONSIBILITY OF THE WINNERS.

Termination
The Administrator may, in its sole discretion, terminate or suspend your access to all or part of the site for any reason, including without limitation, breach of this agreement. In the event this agreement is terminated, the restrictions regarding Materials appearing on the site, and the representations and warranties, indemnities and limitations of liabilities set forth in this agreement shall survive any such termination.
eSpindle Learning reserves the right, in its sole discretion, to reasonably suspend or cancel Word Cup should any virus, bug and/or other cause corrupt the administration, security or proper operation of the Contest. In the event the event is cancelled, eSpindle Learning may, at its sole discretion, determine the winners from among all eligible and non-suspect validated entries received up to the time of such action using the judging procedure outlined above.
General Release and Limitations on Liability
Participant (or if participant is a minor, participant’s parent or legal guardian) hereby acknowledges and agrees that the WORD CUP administrator is not responsible for, and is hereby released from, any costs, injuries, losses, or damages of any kind arising from or in connection with:
(i) the WORD CUP; disputes over ambiguous quiz questions or answers to any questions; entry forms or consent forms that are incomplete, lost, late, misdirected, mutilated, forged, tampered with, destroyed, illegible, postage due or otherwise not in compliance with these Procedures & Rules (and such entries will be disqualified); and failure to receive entry forms or consent forms due to any cause, including, without limitation, human errors or malfunctions of any kind, whether originating with sender, or otherwise, that may limit or impair a contestant’s ability to participate in the WORD CUP;
(ii) any injury or damage resulting from acceptance/possession of a prize, participation in the WORD CUP or any WORD CUP-related activity, and/or the use or misuse of a prize, including, without limitation, claims, costs, injuries, losses and damages related to personal injury, death, damage to, loss or destruction of property (or third party’s property), or any claims, costs, injuries, losses, or damages related to or based on the entrant’s rights of publicity or privacy, or the entrant’s claim that he or she has somehow been defamed or portrayed in a false light; and
(iii) participants who attempt to interfere with other participants’ participation in the WORD CUP (collectively, the “Released Matters”). Without limiting the generality of the foregoing, the WORD CUP administrator is not responsible or liable for interrupted, inaccessible or unavailable quizzes, electronic transmissions, computer transmissions or any inability to participate in the WORD CUP or access any quiz (including, without limitation, the practice quizzes, Word Cup try outs, Semifinals and Finals), event or other WORD CUP-related activity; or for miscommunications; failed, jumbled, scrambled, delayed, or misdirected computer or electronic transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature (including, without limitation, any that occur during the administration of any WORD CUP quiz); or for the incorrect or inaccurate capture of information, or the failure to capture any information (including, without limitation, a participant’s answers to questions on any WORD CUP quiz), and Sponsor reserves the right in its sole discretion to cancel, modify, suspend or extend the WORD CUP (or any portion thereof, including, without limitation, any quiz or the award of one or more prizes) upon the occurrence of any one or more of these events. Each participant (or participant’s parent or legal guardian if participant is a minor) understands and agrees that all rights under SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA and similar law of any state or territory of the United States or International Law or any similar law of another country are hereby expressly waived. Section 1542 reads as follows: “1542. CERTAIN CLAIMS NOT AFFECTED BY GENERAL RELEASES. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” Each participant (or participant’s parent or legal guardian if participant is a minor) waives any and all rights he or she may have or may have under California Civil Code Section 1542, and/or any similar provision of law or successor statute to it, with respect to the Released Matters.
Each winner (or winner’s parent or legal guardian if winner is a minor) acknowledges that the WORD CUP administrator has neither made nor is in any manner responsible/liable for any warranty, representation or guarantee, express or implied, in fact or in law, related to any prize.
If, for any reason (including, without limitation, preemption, interruption and/or cancellation), the WORD CUP is not capable of running as originally planned, the administrator at its sole discretion, reserves the right to cancel, suspend, extend or modify the WORD CUP or any portion thereof.
Data Privacy
The Word Cup, just like the eSpindle tutoring program, is hosted on highly secure servers, using both software and hardware firewalls and various protective mechanisms.
Under no circumstances may the Word Cup administrators be held liable for a data or hacking attack or similar comprising action to the servers.
Word Cup was designed to collect only data absolutely necessary to determine the identity of the participants. eSpindle Learning’s detailed policy, located at http://www.espindle.org/policy.html, applies to Word Cup as well.
By participating in Word Cup you agree that we may publish your name, age category in which you participated, and city/state/country of your residence, should you be one of the finalists. Winners' names will be available at www.Word-Cup.org after September 8th.
Any visual or audio recordings done to document the finals may be shared by eSpindle on an as-needed basis.
Although we have paid a lot of attention and close scrutiny to the privacy aspect of our proceedings, we can only guarantee compliance with US laws. Your country may have regulations and laws that conflict with those outlined in this document and eSpindle’s privacy policy. If you do not agree with these Rules and policies, you may not participate in Word Cup, and your participation constitutes your agreement with these rules.
It is your sole responsibility to ensure that Word Cup complies with all local laws in your place of residence before participating. It's your responsibility to ensure that participating does not conflict with laws in your country. eSpindle Learning may annul your participation at any time and for any reason if a conflict with laws in your local jurisdiction is brought to our attention or you participated without agreeing with the rules outlined here. Due to embargo regulations, residents of Cuba, Iran, Syria, North Korea, Myanmar (formerly Burma) and Sudan are ineligible to participate, sorry! The Contest is void in these countries and anywhere prohibited or restricted by law.
Conditions
Word Cup was designed to comply with US rules and regulations for skill-based competitions. While we open the event to a global audience, we do thereby not make any statement, explicit or implied, that Word Cup complies with all laws within your country. It is your sole responsibility to ensure prior to participation that the event and the rules associated with Word Cup are valid and legal in your country of residence.
THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.
Entrants agree that this Contest shall be governed by and subject to the laws of the state of California and the forum for any dispute shall be in the state of California, United States of America.
Participants who are governed by jurisdiction in conflict with Word Cup rules are excluded from participation and if they do participate, do so at their own risk. The administrator reserves the right to remove participants from the competition, before or after participation, should such conflict be brought to the attention of the event administrator and endanger the legal integrity of the event.
To the extent permitted by law, the right to litigate, to seek injunctive relief, or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and any entrant expressly waives any and all such rights, whether implied by US or foreign legislation.
Governing Law
Any controversy, claim, dispute or cause of action arising out of or relating to (i) the WORD CUP (including, without limitation, any exams, live game play or the use of a participant’s Attributes), (ii) the awarding or redemption of any prize and/or (iii) the determination of the scope or applicability of these Procedures & Rules or their enforcement, arbitrability or interpretation (collectively, “Claims”) shall be governed by and construed in accordance with the substantive laws of the State of California without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s or country's laws.
Arbitration
Except where prohibited by law, as a condition of participating in the WORD CUP, each participant (or if participant is a minor, participant’s parent or legal guardian) agrees that all Claims shall be submitted to final and binding arbitration, to be held in Santa Rosa, California before a single arbitrator, in accordance with California Code of Civil Procedure §§ 1280 et seq. as modified by this provision. All claims shall be resolved individually, without resort to any form of class action; any and all claims, judgments and awards shall be limited to participant’s actual out-of-pocket expenses (i.e., costs associated with participating in the WORD CUP), but in no event will attorneys’ fees be awarded or recoverable; and under no circumstances will any participant be permitted to obtain any award for, and participant (or participant’s parent or legal guardian if participant is a minor) hereby knowingly and expressly waives all rights to seek, punitive, incidental or consequential damages and/or any other damages, other than actual out-of-pocket expenses, and/or any and all rights to have damages multiplied or otherwise increased. The arbitrator shall be selected by mutual agreement of the parties or, if the parties cannot agree, then by striking from a list of arbitrators supplied by the American Arbitration Association and except as otherwise stated in this provision, the arbitration will be conducted in accordance with the rules of the organization that is selected. The arbitration shall be a confidential proceeding, closed to the general public. Each party hereby waives any and all rights and benefits which it might otherwise have or be entitled to under federal law or International Law or the law of their native country or the laws of California or any other state to litigate any such dispute in court, it being the intention of the parties to arbitrate all such disputes. Each party expressly waives any right to a jury. The arbitrator shall issue a written opinion stating the essential findings and conclusions upon which the arbitrator’s award is based. The arbitrator’s decision shall be controlled by the terms and conditions of these Procedures & Rules and any other agreements the applicable entrant may have entered into with Sponsors in connection with the WORD CUP. The parties will share equally in payment of the arbitrator’s fees and arbitration expenses and any other costs unique to the arbitration hearing (recognizing that each side bears its own deposition, witness, expert and attorneys’ fees and other expenses to the same extent as if the matter were being heard in court). In the event that any provision of this arbitration provision or these Procedures & Rules is determined to be invalid or otherwise unenforceable or illegal, the balance of these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained therein.
Appeals
Errors and the correct answers are clearly displayed at the end of each quiz. If you believe that the quiz was terminated erroneously, you may send an email appeal (with delivery confirmation enabled) to the Word Cup administrator at wordcup@eSpindle.org.
The appeal needs to reference the dictionary source that supports your claim. It further needs to contain your Word Cup user name and a few lines explaining why you are filing the appeal.
The decisions on appeals made by the Word Cup administrator are final.
Submissions
Although comments and questions are welcomed, eSpindle Learning does not accept unsolicited submissions or creative ideas for its programs or products. Any messages, suggestions, ideas, or concepts that are submitted shall become, and remain, the property of eSpindle Learning. Furthermore, eSpindle Learning is not responsible for the confidentiality of any information communicated to the eSpindle Web site. By communicating materials to eSpindle’s site, you are granting eSpindle Learning a royalty-free, non-exclusive, perpetual, unrestricted, worldwide license to publish, transmit, perform and display the materials for any purpose, including, but not limited to, advertising and promotional purposes. eSpindle Learning reserves the right at all times to disclose any information necessary in its sole discretion to satisfy any law, regulation or governmental request, or to edit, refuse to post or remove any information or materials, in whole or in part, that in eSpindle’s sole discretion are objectionable or in violation of these terms and conditions.

You may not reproduce, perform, create derivative works from, republish, upload, post, transmit, or distribute in any way whatsoever any Materials from www.eSpindle.org, www.Word-Cup.org or any other Web site owned or operated by the administrator without the prior written permission of the administrator. However, you may print any downloadable items displayed on the site for personal non-commercial home use only, provided all copyright and other notices contained in the Materials are left intact. Any modification of the Materials, or any portion thereof, or use of the Materials for any other purpose constitutes an infringement of the administrator’s copyrights and other proprietary rights.

Amendments
eSpindle Learning reserves the right to amend or interpret the Rules or official contest communications and any element or elements arising under or relating to the contest at any time, upon published notice to participants on the site. A participant shall be deemed to have notice of any such amendments or interpretations upon publication of the same on the site and shall be deemed to have accepted such amendments or interpretations by virtue of a participant’s continuing participation in the contest. Should a Participant not wish to continue to participate in the contest pursuant to the prevailing rules, as amended or interpreted, a participant may terminate participation in the contest by abandoning their registration on the site.
